Second thing -- "the Archie suit" came from Archie counter-suing Penders for his Bioware lawsuit. Penders did not take Shade or the Nocturnus from SEGA (no matter how much he thinks he does), he got a lucky break when Archie failed to produce the original contract he signed stating that his characters would be SEGA's property, and they did not feel like pursuing the case any further (and SEGA was reticent to get involved), so they settled out of court.

There is no relevant factor that says Penders could do a thing about the movie's echidnas. The man is not some all-powerful demigod. His best shot was claiming that clear inspiration = plagiarism back in the Chronicles debacle, and that case was thrown out three times. Now, there is no inspiration. Unless he actually turns into the cartoon caricature who thinks he has legal copyright over the concept of Knuckles having relatives or the species of echidnas, even he knows there's nothing he can do.

What we should expect is some of him taking credit for things in the movie, stating how much better his version would be, saying they should make a Lara-Su movie, and maybe whining about not being credited with completely arbitrary things relating to the echidnas -- nothing actually consequential.

There is a non-zero chance he takes this to court if he's actually grown to believe his own bullshit, which he might have done.

However he would lose, Paramount have the money and resources to drive out a lawsuit, and SEGA being involved as well will make things hell for him. He got absurdly lucky with Archie, presumably because they were already dealing with financial issues at the time, but as explained he never actually won the case. An out of court settlement is not what a victory makes, of which I might note a settlement he's very reluctant on talking about.

This is laughable. While the Archie case did end up down the shitter, this is a completely different story. He created none of these characters. I can't wait for this to go to court and make headline news showing what a complete tool he is.

I have been lurking this topic for the longest time just to stay in the loop (mostly because I didn’t have anything to contribute really and I don’t want to really risk insulting someone who is pretty much unrelated to the Sonic franchise at best), but if he’s truly planning on taking on Paramount.

Could you imagine if this went in a direction where Penders last suit was investigated found out that he was totally full of shit and was forced to give all his characters back.

It's so very amusing how he claims to have all of these 'counter-arguments' lined up, as if Paramount's (highly paid and highly skilled) legal team won't have about twenty counter-counter-arguments for each and every single one he has, along with more than enough evidence to prove these come from the games.

Oh right, and let's not forget that mythical legend Ken seems to not be able to grasp - 'common sense'. 

But you know what? I'm sure Ken won't absolutely be utterly fucking laughed out of the courtroom when he's asked the very simple question of "have you seen the infringing content in question?" and the response has to be "Well no but someone on Twitter told me they were!" 

On the bright side, maybe Ken will be able to ask Digital Homicide to make a Lara-Su game for him.

Can’t see that happening as they would need to find documentation that his characters ownership was to Sega and not him

I personally love the irony that just a couple days ago he swiped art from a former colleague and collaborator, painted over it, and resold it as merchandise (including using trademarked logos that do not belong to him and are the most likely thing to get him into trouble) and here he is, whining about vague, surface level similarities to his work that aren't even rooted in his work.

Paramount would have to go out of their way to actually give Ken a genuine reason to sue them lol. I mean what happens if Knuckles shares even a fraction of a second of screen time with an earth ant before squishing it? Is that Ant infringing on his copyright of Archimedes lol?
