God I still remember him trying to brush off Shade appearing in that book by somehow trying to frame it as not counting because it was written by Ian Flynn. As if it was, somehow, an official Sonic Guide that had been purely made by Ian without any input or endorsement from SEGA.

That assumes he ever had any. I honestly wouldn't be surprised if he had a lawyer try to explain it, he misunderstood it badly, and now thinks he's an expert in the subject...

According to the record listings he posted, they don't prove he owns Julie-Su. One of the records he posted outright states he doesn't own anything outside of the script/story for that issue.

Not claiming to be an "expert", but you don't copyright ideas like a character or location, you copyright specific products such as a story or a drawing. Say I write a story about Shadow the Hedgehog and his pet Bubbles the Goldfish. If I were to copyright my story, "Shadow and his pet Bubbles the Goldfish", I would verify that I owned my story and the original ideas first presented in it, such as ownership of Bubbles the Goldfish. I don't need a separate copyright for Bubbles, I just need a copyright for the story where the idea of Bubbles originated from. Similarly, my ownership does not extend to concepts that did not originate from my story. Ownership of "Shadow and his pet Bubbles the Goldfish" doesn't give me ownership of Shadow the Hedgehog, because he's a pre-existing idea owned by Sega via "Sonic Adventure 2". So Ken doesn't need to own a copyright for Julie-Su, just a copyright for the story in which the idea of her was first introduced - "KNUCKLES THE ECHIDNA Book Four LOST PARADISE - The Phantom City". Ken actually was not aware of this distinction at first, as back in 2012 he actually held a copyright for Hershey the Cat separate from his story copyrights (Hershey was unique among the cast in that her name was taken from a cat of his). That copyright seems to have been removed since then however and Hershey is simply attributed to the story in which she was first introduced. The records state he only owns his script because he's not claiming he owns things like art or coloring in the issue which was done by other people; he still owns the ideas introduced by his script.

It's worth noting that it's for this exact reason he IS lying about owning Shade and the Nocturnus though. He does not own the copyright to Sonic Chronicles: The Dark Brotherhood which would be how he would own the ideas introduced in that work such as characters or locations. What he claims is that ownership of Julie-Su and the Dark Legion gives him ownership, but that would only be true if a court ruled that to be the case. Which they did not, his lawsuit against Sega and EA was thrown out multiple times. However, the fact it was thrown out without prejudice means Ken can attempt to sue Sega and EA about it again to once again dispute their ownership of this material. He chooses not to allegedly I assume because Sega and EA aren't profiting off the concepts from Sonic Chronicles at this time, but more realistically it's because he knows he wouldn't win that case because its clear that the concepts in Sonic Chronicles, while inspired by his Archie comics, are different enough to be legally distinct ideas. But he's not going to admit that in case he does sue Sega or EA in the future, because to do so would undermine his case. We'd have to see if Sega or EA would attempt to sue Penders for using Shade's name and design in The Lara-Su Chronicles like he claims he's going to.

This is all also why Ken shouldn't be able to use Scourge's design, because it doesn't originate from one of his stories and is clearly distinct from the design he may have come up with in the layouts for "The Good the Bad and the Hedgehog". The name and design was from Patrick Spaziante and was urged by Mike Pellerito, Ian may also have come up with the name Scourge. Ken allowing the Rush team to use the Scourge name and design for profit should have been a copyright violation, though I don't know if Spaz or Mike or especially Ian would try to sue Penders over it.

You know, if you gave Julie-Su's coloring to Shade she doesn't look like a dead ringer for Julie-Su as opposed to if you do the same thing with Scourge and Sonic.

Well yeah, there never would have been a reason for anyone to think Penders owned anything from Chronicles if it weren't for the fact that he keeps lying about it. His rationalization -- that he can claim ownership of it due to it being plagiarized -- would be dubious if it had been plagiarized, except we have explicit legal documentation of him failing to prove that it was plagiarized in the first place. For any of this shit to actually make sense, he'd have to actually win the court case, which he didn't.

I don't know why Ken keeps on trying to say that Shade is his property, despite the fact that he kept losing the case when he tried to bring it up.  Best to just give up on trying to claim Shade.

BTW, Ken posted additional copyright stuff for his Knuckles stories and he's literally including "Green Knuckles" and "Future Knuckles" in his copyrighted characters. For the record, that's referring to "Knuckles after he was hit by the Chaos Syphon for 20 or so issues" and "Knuckles but 25 years older". Try to keep up with that logic. "You may have made Evil Sonic green and given him a new name, but the character Scourge still belongs to me because he's the same character. By the way, I made Sega's Knuckles the Echidna green and didn't give him a new name, so I own that version."

We just got "Imposter Syndrome" comic about Eggman's worshiper and clones of Sonic and Tails, all three inspired by glitches from the games and that still feels more like original work than 80% of Ken's work.

(I Just checked. He's dingo soldier with less than 3 pages of screen time (KtE 6), his whole role is a scene that I'm 90% sure Ken stole from Captain America (Tales of Suspense '59 #68).
